Foreclosure Opinion Letter

Homeowners facing foreclosure need to educate themselves in order to put up the best defense available to them. The following is provided for informational purposes only. Everyone in foreclosure should hire an attorney to represent them in the proceeding.

What is a Foreclosure Opinion Letter (FOL)?
An FOL is a written legal opinion that is the product of an investigation in to the closing of your loan. We will take your closing documents and analyze them to uncover violations of federal and state law. The FOL will give you a detailed analysis of any violations that we uncover and the potential remedies that coincide with each violation.

How much is an FOL going to cost me?
We charge $500 for an FOL. There are many companies out there today that purport to offer similar types of analysis.  However, none of them are in New Jersey, and none of them, are law firms that actually represent foreclosure clients in New Jersey courts!  We are a law firm, not a former loan officer or other professional that has decided to venture into the foreclosure maelstrom to make a quick profit.  We are in the business of ultimately helping homeowners defend foreclosure actions, not simply a business trying to sell audits. 

The FOL will be the basis of your case should you ultimately hire us to defend you in court.  Therefore, we take great care and consideration into crafting your FOL so that we can leverage the information we uncover to the greatest extent possible when defending your rights in court.


How can an FOL help me?
The audit is used to uncover violations of the law governing consumer mortgage transactions. Certain violations offer strong counter-claims and defenses. For example, if your lender violated the Truth in Lending Act (15 USC 1601, et seq.) it may have to dismiss your foreclosure complaint or even extinguish the mortgage. In essence, the money you spend on your audit may uncover violations of the law that can save you thousands of dollars and prevent your lender from foreclosing on your home.
